These Terms of Service govern your use of www.finesupplements.co.uk and any order you place directly through the website.

In these Terms, “Fine Supplements”, “we”, “us” and “our” refer to Fine Supplements Limited. “You” and “your” refer to the person accessing the website or purchasing from us.

We may refuse or cancel an order where we reasonably believe that the eligibility requirements have not been met.

3. Health, Nutrition and Product Information

Information provided on this website is for general product and educational purposes only. It is not medical advice and must not be used as a substitute for advice, diagnosis or treatment from a qualified healthcare professional.

Food supplements must not be used as a substitute for a varied, balanced diet and healthy lifestyle.

Before using a product, you should:

  • Read the full product label and manufacturer instructions;
  • Check the ingredients, allergens, warnings, dosage and suitability information;
  • Check that the product is suitable for your individual circumstances;
  • Follow the manufacturer’s recommended use and storage instructions; and

Do not exceed the recommended dose. Stop using a product and seek appropriate professional advice if you experience an adverse reaction.

Products intended for animals must be used only for the species, age and purpose stated by the manufacturer. Veterinary advice should be obtained where appropriate.

These health and product-information provisions do not exclude liability for defective or unsafe products, negligence, fraud or any statutory right that cannot legally be excluded.

4. Product Descriptions and Images

We take reasonable care to ensure that product descriptions, images, ingredients, quantities, strengths, sizes and other information are accurate.

Manufacturers may occasionally change packaging, labels, ingredients, formulation, colour, design or product specifications without prior notice. Images may therefore show previous or representative packaging.

Such changes will not affect your statutory rights. If a change materially affects the nature, composition, quantity or suitability of a product, the information supplied with the product will take priority and you should not use the product if it is unsuitable for you.

Screen settings, lighting and photographic conditions may cause colours or appearance to vary slightly from the physical product.

You are responsible for checking the product label and packaging before use, particularly where ingredients, allergens, dosage or suitability are important to your purchase.

If the product received is materially different from its description or is not what you ordered, please contact us before opening or using it.

5. Availability

All products are offered subject to availability.

Adding a product to your basket does not reserve it. A product may become unavailable before your order is accepted or dispatched.

If a product becomes unavailable after you place an order, we may:

  • Cancel the affected product and issue a refund;
  • Contact you to offer an appropriate alternative; or
  • Delay dispatch with your agreement.

We will not substitute a materially different product without your agreement.

We may set reasonable limits on the quantity of products purchased by one customer, account, household, payment method or delivery address.

6. Prices, Taxes and Errors

Prices are displayed in the currency shown on the website and normally include applicable UK VAT where VAT is chargeable, unless stated otherwise.

Delivery charges and any other applicable charges will be displayed before you confirm your order.

We take reasonable care to display accurate prices, but genuine pricing or listing errors may occasionally occur.

If we discover an obvious pricing, discount, quantity or product-information error before accepting your order, we may:

  • Contact you and ask whether you wish to proceed at the correct price; or
  • Cancel the affected order and refund any amount paid.

We are not required to supply a product at an obviously incorrect price where the error would reasonably have been recognised as a genuine mistake.

We will not increase the price of an accepted order without your agreement, except where a change is required by law and you retain any applicable right to cancel.

7. Placing an Order

When you place an order, you are making an offer to purchase the products in your basket subject to these Terms.

After receiving your order, we will normally send an order acknowledgement. This acknowledgement confirms receipt of your order but does not necessarily mean that we have accepted it.

A binding sales contract is formed when we send confirmation that the order has been dispatched, unless we expressly accept the order at an earlier time.

Each dispatched shipment may form a separate contract where products from one order are dispatched separately.

We may decline or cancel an order before acceptance for a legitimate reason, including:

  • The product is unavailable;
  • Payment is not authorised or is later reversed;
  • The delivery address cannot be serviced or verified;
  • There is an obvious price, description or quantity error;
  • An applicable purchase restriction has been exceeded;
  • We reasonably suspect fraud, abuse, unlawful activity or unauthorised resale;
  • The order appears to breach these Terms; or
  • We are unable to supply the product lawfully or safely.

If we cancel an order after receiving payment and before supplying the product, we will refund the cancelled amount to the original payment method.

8. Payment

You must pay the full amount shown at checkout using an accepted payment method.

By providing payment details, you confirm that:

  • You are authorised to use the payment method;
  • The payment information is accurate;
  • Sufficient funds or credit are available; and
  • The payment does not involve fraud or unlawful activity.

Payments may be processed by third-party payment providers. Their own terms and privacy notices may also apply to the payment service they provide.

We may carry out or request reasonable payment, identity, address or fraud-prevention checks before accepting or dispatching an order.

Failure of a payment authorisation does not create an obligation for us to supply the order.

9. Promotions, Discount Codes and Store Credit

Promotions and discount codes are subject to any specific conditions displayed with the relevant offer.

Unless stated otherwise:

  • Only one discount code may be used per order;
  • Discounts cannot be applied retrospectively;
  • Discounts have no cash value;
  • Discounts cannot be transferred, sold or reproduced;
  • Excluded products, brands or categories may apply;
  • Minimum-spend requirements are calculated after excluded products and discounts;
  • Delivery charges do not normally count toward a minimum spend; and
  • A promotion may be withdrawn or corrected before an order is accepted where a genuine error or misuse has occurred.

We may reject or cancel the use of a promotion where we reasonably believe it has been obtained, distributed or used fraudulently, unlawfully or contrary to its published conditions.

If part of a discounted bundle, multi-buy or threshold promotion is returned, we may recalculate the price of the products retained to reflect the offer that would have applied to those products alone, where this was clearly disclosed and is permitted by law.

Any refund will normally reflect the amount actually paid after discounts.

10. Delivery

Available delivery methods, estimated timeframes and charges are shown during checkout and are explained further in our Shipping Policy.

Delivery dates and timeframes are estimates unless we expressly agree that a particular date is guaranteed.

We aim to deliver within the stated timeframe and, unless another period is agreed, within the time required by applicable consumer law.

You are responsible for providing a complete and accurate delivery address and any information reasonably necessary for delivery.

We are not responsible for delays or failed delivery caused by incorrect, incomplete or inaccessible address information supplied by you. We may charge reasonable additional costs arising from redelivery or recovery where permitted by law.

Where you request or authorise a parcel to be:

  • Left in a safe place;
  • Delivered to a neighbour;
  • Redirected to another address; or
  • Delivered according to instructions given directly to the carrier,

you are responsible for ensuring that the location or instruction is suitable and secure. This does not exclude liability where loss or damage was caused by our breach, the carrier acting on our behalf or a failure to follow the agreed delivery instructions.

11. Risk and Ownership

Risk of loss or damage normally passes to you when the goods are delivered into your physical possession or the possession of a person identified by you to receive them.

If you independently appoint a carrier that was not offered or arranged by us, risk may pass when the goods are delivered to that carrier, as permitted by law.

Legal ownership of the goods passes to you only after we have received payment in full.

12. Cancellation, Returns and Refunds

Your cancellation, return and refund rights are explained in our Return and Refund Policy.

Our voluntary 60-day returns period includes, and is not added to, the statutory 14-day cancellation period.

Products supplied sealed and not suitable for return due to health protection or hygiene reasons may lose the statutory cancellation right if they become unsealed after delivery.

This does not affect your statutory rights where goods are faulty, damaged, unsafe, incorrectly supplied or not as described.

13. Product Recalls and Safety Notices

If we or a manufacturer identify a product-safety concern or recall, we may contact affected customers using the contact information supplied with their order.

You should follow any recall or safety instructions promptly and stop using the affected product where instructed.

We may request the product’s batch number, expiry date, photographs or other information needed to identify whether it is affected.

Product recalls and safety issues will be handled in accordance with applicable law and the instructions of the relevant manufacturer, supplier or authority.

14. Customer Accounts

You may be able to purchase as a guest or create a customer account.

You are responsible for:

  • Providing accurate and current account information;
  • Keeping your login details confidential;
  • Taking reasonable steps to prevent unauthorised account access; and
  • Notifying us promptly if you suspect unauthorised use.

We may suspend or restrict an account where reasonably necessary to protect customers, investigate suspected fraud, maintain website security or enforce these Terms.

You must not create multiple accounts to circumvent purchase limits, promotional conditions, account restrictions or other reasonable controls.

15. Permitted Use of the Website

You may use the website only for lawful personal or business-purchasing purposes consistent with these Terms.

You must not:

  • Use the website for unlawful, fraudulent or malicious purposes;
  • Attempt to gain unauthorised access to the website, customer accounts or connected systems;
  • Introduce viruses, malware or harmful code;
  • Interfere with the operation, availability or security of the website;
  • Scrape, extract or harvest data using automated means without written permission, except where such restriction is prohibited by law;
  • Misrepresent your identity or authority;
  • Use another person’s payment information without permission;
  • Manipulate pricing, promotions, reviews or website functionality;
  • Use the website to infringe another person’s rights; or
  • Attempt to bypass purchase, territorial, account or security restrictions.

We may take proportionate action to prevent or investigate prohibited activity, including restricting access, cancelling unaccepted orders or reporting suspected criminal activity to the appropriate authorities.

16. Reviews and Customer Content

If you submit a review, comment, image or other content, you confirm that:

  • It reflects a genuine experience where presented as a customer review;
  • It is accurate to the best of your knowledge;
  • You have the right to submit it;
  • It does not infringe intellectual-property, privacy or other rights;
  • It is not defamatory, threatening, abusive, discriminatory or unlawful;
  • It does not contain malicious code or misleading links; and
  • Any incentive or relevant commercial relationship is clearly disclosed.

You must not submit, commission or arrange fake or misleading reviews.

We may moderate or remove content where reasonably necessary to comply with law, protect rights, address irrelevant or abusive material, prevent fraud or enforce these standards.

We will not remove a genuine negative review solely because it is unfavourable.

You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and use it for operating and promoting our business, subject to applicable data-protection and consumer law.

17. Intellectual Property

The website and its content, including text, graphics, logos, layout, software, product arrangements and original images, are owned by or licensed to Fine Supplements and are protected by applicable intellectual-property laws.

You may access and use the website for personal, non-commercial shopping purposes.

You must not reproduce, republish, distribute, modify, sell, commercially exploit or create derivative works from protected website content without our prior written permission, except where permitted by law.

Third-party product names, trademarks and images remain the property of their respective owners.

19. Website Availability

We aim to keep the website secure and available but cannot guarantee that access will always be uninterrupted or error-free.

We may temporarily suspend, restrict or modify website access for maintenance, security, updates or circumstances beyond our reasonable control.

We will take reasonable care when operating the website. Nothing in this section excludes liability for losses caused by our failure to use reasonable care and skill where liability cannot lawfully be excluded.

20. Our Liability to Consumers

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

Loss is foreseeable if it was an obvious consequence of the breach or if both you and we knew it might occur when the contract was formed.

We do not accept responsibility for losses that:

  • Were not reasonably foreseeable;
  • Were caused by your failure to follow lawful product instructions or warnings;
  • Were caused by inaccurate information supplied by you;
  • Could reasonably have been avoided by you taking appropriate action; or
  • Relate to commercial activity where you purchased as a consumer.

Products sold through the website are intended primarily for personal use. If you use products for commercial, resale or business purposes, we are not responsible for loss of profit, revenue, contracts, business opportunity or business interruption, except where liability cannot lawfully be excluded.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation;
  • Defective products where liability cannot lawfully be excluded;
  • A deliberate breach intended to cause loss;
  • Your statutory consumer rights; or
  • Any other liability that cannot legally be excluded or limited.

21. Events Beyond Our Reasonable Control

We are not responsible for delay or failure caused by an event beyond our reasonable control, provided that we take reasonable steps to minimise its effects.

Such events may include severe weather, fire, flood, epidemic, transport disruption, industrial action, carrier-network disruption, failure of utilities or communications, cyber incidents affecting third parties, governmental action, import restrictions or supply-chain interruption.

If such an event materially delays your order, we will contact you where reasonably possible. If there is a risk of substantial delay, you may contact us to cancel the affected order and receive a refund for products not supplied, subject to applicable law.

22. Suspected Fraud and Abuse

We may investigate transactions, accounts, claims or returns where we reasonably suspect fraud, substitution, payment abuse, promotional abuse or other unlawful activity.

Where proportionate and lawful, we may:

  • Delay acceptance while reasonable checks are completed;
  • Decline or cancel an order before acceptance;
  • Restrict an account or payment method;
  • Request reasonable verification;
  • Preserve relevant transaction records; or
  • Report suspected criminal conduct to payment providers or appropriate authorities.

This section does not permit us to withhold a refund or remedy that you are legally entitled to receive.

23. Privacy and Cookies

We process personal information in accordance with our Privacy Policy.

Information about cookies, analytics and advertising technologies should be read together with our Privacy Policy and the choices available through our cookie-consent controls.

24. Changes to These Terms

We may update these Terms to reflect changes in law, our website, our products or our business practices.

The Terms applying to an order are normally those made available when the order was placed. We will not retrospectively change an accepted order in a way that removes or reduces your statutory rights.

The date shown at the top indicates when these Terms were last updated.

25. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Any invalid provision will be treated as modified only to the minimum extent necessary to make it lawful and enforceable, where legally permitted.

26. No Waiver

If we delay exercising a right or do not exercise it on one occasion, this does not necessarily mean that we have permanently waived that right.

This provision does not allow us to act unfairly or to revive a right where doing so would be unlawful.

27. Third-Party Rights

These Terms are between you and Fine Supplements Limited. Except where applicable law provides otherwise, no other person has a right to enforce them under the Contracts (Rights of Third Parties) Act 1999.

28. Governing Law and Courts

These Terms and contracts formed through the website are governed by the laws of England and Wales.

If you live in England or Wales, the courts of England and Wales will normally have jurisdiction.

If you live in Scotland or Northern Ireland, you may bring proceedings in the courts of the part of the United Kingdom where you live. You also retain the benefit of any mandatory consumer protections applying in your place of residence.
